Trump Wants E-Commerce Companies Liable For Counterfeit Sales

President Donald Trump made a push to hold e-commerce marketplaces like Amazon and eBay accountable for counterfeit goods sales through fines and civil penalties, ordering federal law enforcement officials to prepare a legislative proposal to codify that policy.

In a memo to the homeland security secretary and the attorney general, the president directed certain federal agencies to focus their enforcement efforts on combating counterfeit sales on e-commerce platforms. The memo said they should pursue legislation that would “clarify and strengthen the executive branch’s authority” and resources to fight online counterfeit sales.

The memo said that selling counterfeit goods poses health and safety risks, infringes the intellectual property rights of American companies, undermines competition and harms U.S. workers.

“E-commerce platforms serve as key contributors to counterfeit trafficking by acting as intermediaries and providing marketplaces that match up buyers and sellers,” the memo said.

In order to achieve its goal, the memo directed the homeland security secretary to impose fines and civil penalties against e-commerce platforms, seize counterfeit goods and submit a legislative proposal that would outline those new policies within 120 days.

The memo comes on the heels of another executive order Trump issued in January that aimed to crack down on online sales of counterfeits and knockoffs. That order allocated more federal resources to the inspection and oversight of imports that are at risk for counterfeits and other illicit goods. It also directed U.S. Customs and Border Protection to heighten the requirements for its importer of record program and give the boot to companies that have a track record of flouting U.S. import laws.
