Selling generic earphones through Amazon under your own private label brand has long been a popular trend for third party sellers.
Many of the sets sourced from Alibaba are exact copies of popular Apple accessories, with the only difference being the logo on their outer box‘s packaging.
When advertising such items for sale, you are not only risking the receipt of Intellectual Property Rights Infringement Complaints which may seriously damage your Seller Account, but also facing potential issues with the local authorities.
The United States customs has recently started cracking down on Apple knock-offs, which was demonstrated by seizing 2000 pieces of OnePlus Buds at JFK airport.
CBP publicized the action and described the OnePlus Buds as “counterfeit Apple AirPods,” which set off a wave of controversy. It seemed like a possible error by border officers who somehow didn’t realize they were blocking a genuine product, since OnePlus has been selling the items across popular retail stores including Walmart or Best Buy.
But CBP’s statement seems to rule out this being a mistake.
“Upon examining the shipment in question, a CBP import specialist determined that the subject earbuds appeared to violate Apple’s configuration trademark. Apple has configuration trademarks on their brand of earbuds, and has recorded those trademarks with CBP,” the spokesperson said.
Configuration trademarks cover the general appearance of a product, which suspected violations often lead to infringement complaints on Amazon, when sellers fail to properly research intellectual property before launching their private label products.
