First and foremost, if your packaging falls under the category of “packaging subject to system participation,” you are required to enter into a system participation contract with one or more Producer Responsibility Organizations (PROs). According to German law, packaging subject to system participation refers to packaging that is typically disposed of by private consumers. This includes packaging for retail, grouped items, services, and shipments.
Additionally, it’s important to report your packaging volumes to the German packaging authority known as ZSVR (Zentrale Stelle Verpackungsregister) on a regular basis, at least once per year. If you utilize Amazon’s FBA services, you are responsible for reporting the volume of secondary packaging that Amazon uses to ship your products.
On the other hand, if your packaging is not subject to system participation, you may not need a system participation contract, although you may still need to register. This category includes transport packaging, reusable packaging, single-use beverage packaging subject to deposits, retail packaging for hazardous contents, and retail grouped packaging that does not typically accumulate as waste with private consumers. By visiting Amazon EPR Reports, you can download detailed information about the sales of your products on amazon.de that are subject to EPR regulations, including packaging, specifically for Germany.
For any other products you sell, you will need to determine the packaging material and mass. Then, you can declare your sales of packaged goods to the ZSVR on the LUCID Portal and to your chosen PRO. It’s important to pay the requested fees to your PRO for the applicable reporting periods. The fees depend on the material and quantity of packaging placed in Germany within a given calendar year.
