Compliance with Extended Producer Responsibility (EPR) Obligations for WEEE in Germany

In this article, I will be addressing some information and guidance regarding the submission of proof of compliance with Extended Producer Responsibility (EPR) obligations for waste from electrical and electronic equipment (WEEE) in Germany. It is essential to stay informed and take action to ensure your business remains compliant with the latest requirements. Here are the key points you need to know:

  1. Submit Your WEEE-Reg.-Nrs. on the Compliance Portal: When submitting your registration numbers (WEEE-Reg.-Nrs.), it is crucial to do so only once the Stiftung ear portal has made it visible. Please note that this visibility may take up to 72 hours. If we cannot locate your WEEE-Reg.-Nr. on the Stiftung ear portal, it will be marked as invalid. Therefore, it is crucial to follow this timeline to avoid any issues.
  2. Brand Registration with Amazon: To submit your WEEE-Reg.-Nrs. on the Compliance Portal, you must register your brand with Amazon. Detailed instructions on how to do this can be found on the “EPR requirements: WEEE in Germany” help page. Take the time to familiarize yourself with the process and ensure your brand registration is complete to avoid any disruptions.
  3. Non-Producers and Upstream Suppliers: If you are not the producer of the brand and type of equipment combination, you need to provide us with the WEEE-Reg.-Nr. of your upstream supplier. Additionally, you must check the designated box on the Compliance Portal to confirm that you are not the producer. It is vital to provide accurate information and comply with this requirement to maintain compliance.
  4. Impact on Pan-European Services: For those sellers who benefit from Pan-European services, please be aware that if your EEE (Electrical and Electronic Equipment) listings are deactivated, it will affect your offers on other Amazon EU stores. Consequently, you may incur cross-border shipping costs and will no longer enjoy fast delivery times for those affected ASINs. Take this into consideration when planning your business operations.
  5. Authorized Representative Compliance: If your authorized representative is not listed on the Stiftung ear list, it is necessary to check with your service provider and take the required steps to become compliant. Ensure your authorized representative is correctly registered to avoid any future disruptions to your listings.
  6. Deactivation of Non-Admitted Authorized Representative Listings: Starting from July 1, 2023, any listings with a WEEE-Reg.-Nr. from a non-admitted authorized representative will be deactivated. To avoid this, make sure you provide the new valid registration number promptly to reinstate your listings.
  7. Possible Deactivation of Non-Compliant Listings: From June 5, 2023, Amazon may deactivate certain non-compliant listings. This deactivation process takes approximately four weeks to confirm if your offers have a valid registration at the brand and type of equipment level. To maintain uninterrupted operations, ensure your registration is up-to-date within the given timeframe.

It is crucial for Amazon sellers to stay informed about regulatory updates and comply with the latest requirements. Failing to do so may result in disruptions to your business operations and potential financial implications. Take the time to review these important updates and take the necessary steps to maintain compliance with the Extended Producer Responsibility (EPR) obligations for WEEE in Germany.

Additionally, here are some extra tips shared by Amazon:

During the registration application with the German WEEE authority Stiftung ear, it is mandatory to include your product’s details and forecasted quantities for each listing. To help you build the sales forecast, you can use the 2022 EPR Reports as a baseline, to which you can add your sales volume on channels outside Amazon, if applicable, and your estimated sales growth for 2023.

When appointing an authorized representative, be aware that the power of attorney form should be filled in by hand and signed with ink (not digitally) and then scanned to PDF.

In order to become compliant with WEEE in Germany, producers have to comply with their financial obligations. Please take prompt action to meet these obligations in order to facilitate your registration with Stiftung ear.For more information, check the Guide EPR WEEE requirements in Germany.
If your authorized representative is not on the Stiftung ear list, you need to check with your service provider and take the required steps to become compliant. As a reminder, non-compliant listings may be deactivated starting June 5, 2023.

Amazon can help you become compliant through EPR Services on Amazon as our trusted EPR service providers are either admitted authorized representatives or are partnering with admitted authorized representatives.
